Welcome to Okona. By accessing or using our platform at okonaonline.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our service.

Description of Service

Okona is a curated catalog of phone-controlled multiplayer games, played in the Okona app in a web browser or webview on a television, projector, kiosk, digital sign or computer. Players use their smartphones as controllers by scanning an on-screen QR code; USB and Bluetooth gamepads work too. Independent developers build the games and submit them to Okona, and Okona reviews each one and decides which appear in the catalog. Our service includes the Okona app, the phone controller and, for developers, tools to build, test and submit games and to see how they are played. No downloads or additional hardware are required to play.

User Accounts

Some features of Okona require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate information when creating your account and keep it up to date. We reserve the right to suspend or terminate accounts that violate these Terms. You can browse the Okona app without an account; playing requires an account with Okona Plus. You can delete your account at any time from its Account page. Developer accounts are available by invitation or on request, at Okona’s discretion.

Acceptable Use

You agree not to use our platform to upload or distribute content that is illegal, harmful, threatening, abusive, or otherwise objectionable. You may not attempt to gain unauthorized access to our systems, interfere with the operation of the platform, reverse-engineer our software, or use automated tools to scrape or collect data from our service. You also agree not to impersonate other users or misrepresent your identity.

Intellectual Property

The Okona platform, including its design, code, and branding, is owned by Okona and protected by intellectual property laws. Games hosted on our platform remain the intellectual property of their respective developers. You may not reproduce, distribute, or create derivative works from any content on our platform without explicit permission from the rights holder.

Subscriptions and Payments

Okona Plus. Playing the games in the Okona app requires an Okona Plus subscription. Building and submitting games as a developer is free.

Okona Plus is billed monthly or yearly, in advance, through Stripe, at the price shown before you subscribe, plus any applicable sales tax. It renews automatically at the end of each period until you cancel. A new member may be offered a free trial, once per account: a card is required, and unless you cancel before the trial ends, the first payment is taken when it ends. A change between monthly and yearly takes effect at your next renewal.

At home or in public. You may use Okona Plus at home or at a business open to the public, such as a bar, café or event, on up to two screens at once with one membership. A business is responsible for any other licence its location needs to show content in public.

You can cancel at any time from your Account page. You keep Okona Plus until the end of the period you have paid for, and we don’t refund the rest of a period you have started, except where the law requires it; other refunds are at Okona’s discretion. If a payment fails, we retry it for a limited time and your membership ends if it can’t be collected. Deleting your account ends Okona Plus immediately, without a refund. One membership can play on up to two screens at the same time. All prices are in US dollars; we will tell you about a price change at least 30 days before it applies to your next renewal.

Developer Terms

Developers who submit games to Okona keep ownership of them. By submitting a game, a developer grants Okona a non-exclusive, worldwide license to host, display and make that game available to players through the Okona app, and to use its title, description, icon and screenshots to present it in the catalog and promote Okona. Developers are responsible for ensuring their games comply with our content guidelines and do not infringe anyone else’s intellectual property. Because games may be played in public places, a developer confirms, by submitting a game, that its music and other audio are original or licensed for public performance.

Review and the catalog. Okona reviews every submitted game and decides, at its discretion, which games appear in the catalog. Okona may approve a game, send it back with the changes it needs, or decline it, and may remove a game from the catalog at any time, including to protect players or the service. Games submitted to Okona play only inside the Okona app; Okona does not give them a public web address. A developer may withdraw a game from review, or remove it from the catalog, at any time.

Disclaimer of Warranties

Our service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the service will be uninterrupted, error-free, or free of harmful components. We are not responsible for the content of third-party games hosted on our platform.

Limitation of Liability

To the maximum extent permitted by law, Okona shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our service. Our total liability for any claim related to the service shall not exceed the amount you paid us in the 12 months preceding the claim.

Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page. Your continued use of the platform after changes are posted constitutes acceptance of the revised Terms.

Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or your use of the service shall be resolved through binding arbitration.
