Welcome to Okona. By accessing or using our platform at okonaonline.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our service.

Description of Service

Okona is a hosting platform for phone-controlled interactive multiplayer web games. We host interactive web games (such as Unity WebGL builds) made by developers, provide each game with a URL that runs in any web browser or webview — including on televisions, projectors, kiosks and digital signs — and let players use their smartphones as controllers by scanning an on-screen QR code. Our service includes hosting, the phone controller interface, developer tools, and engagement analytics. No downloads or additional hardware are required to play.

User Accounts

Some features of Okona require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate information when creating your account and keep it up to date. We reserve the right to suspend or terminate accounts that violate these Terms.

Acceptable Use

You agree not to use our platform to upload or distribute content that is illegal, harmful, threatening, abusive, or otherwise objectionable. You may not attempt to gain unauthorized access to our systems, interfere with the operation of the platform, reverse-engineer our software, or use automated tools to scrape or collect data from our service. You also agree not to impersonate other users or misrepresent your identity.

Intellectual Property

The Okona platform, including its design, code, and branding, is owned by Okona and protected by intellectual property laws. Games hosted on our platform remain the intellectual property of their respective developers. You may not reproduce, distribute, or create derivative works from any content on our platform without explicit permission from the rights holder.

Subscriptions and Payments

Building, hosting and collaborating on Okona are free. One feature requires a paid subscription: Okona Pro, a monthly subscription per organization that removes the visible "Powered by Okona" watermark from the organization’s live games (in the game and on the phone-controller page) and includes access to the Analytics API. Subscriptions are billed on a recurring basis through Stripe. You may cancel a subscription at any time through your account settings or billing portal, and you will retain access until the end of your current billing period; when an Okona Pro subscription ends, your game URLs continue to work and the watermark returns. Refunds are handled on a case-by-case basis. All prices are listed in US dollars and may be subject to change with notice.

Developer Terms

Developers who publish games on Okona retain ownership of their content but grant Okona a license to host, display, and distribute those games through the platform. Developers are responsible for ensuring their games comply with our content guidelines and do not infringe on third-party intellectual property. Developers decide how and where to display the games they create; Okona is not a party to arrangements between developers and their own clients.

The watermark. Every published game has a free URL that plays anywhere. Okona may display a visible "Powered by Okona" watermark in the game and on the phone-controller page for organizations without an active Okona Pro subscription, and may limit phone-controller pairing to games that Okona serves.

Disclaimer of Warranties

Our service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the service will be uninterrupted, error-free, or free of harmful components. We are not responsible for the content of third-party games hosted on our platform.

Limitation of Liability

To the maximum extent permitted by law, Okona shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our service. Our total liability for any claim related to the service shall not exceed the amount you paid us in the 12 months preceding the claim.

Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page. Your continued use of the platform after changes are posted constitutes acceptance of the revised Terms.

Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or your use of the service shall be resolved through binding arbitration.
